THIS ORDINANCE WAS, UH, INACTIVE FORMALLY.

AND, UM, SO WHAT WE'RE DOING HERE AFTER MUCH STUDY, AND AS YOU ALL KNOW, BOTH THE PLANNING AND ZONING COMMISSION AND THE COUNCIL HAVE BEEN LOOKING AT THIS.

THIS IS A, BASICALLY A REAL REWRITING OUR ZONING ORDINANCE THAT WAS ENACTED ON NOVEMBER 12TH, 1973, UM, WHAT THE PUBLIC HAS HAD.

AND I JUST WANT TO BRIEFLY TOUCH FOR THE RECORD ON THE NOTICE REQUIREMENTS.

WE DID HAVE ALL OF THE NOTICES RUN IN BOTH THE PORT ARTHUR NEWS AND THE BEAUMONT ENTERPRISE.

WE HAD ALL THE INFORMATION ON OUR WEBSITE AS WELL, WHICH WAS THE NOTICE THAT YOU READ GIVEN THE PUBLIC, UM, THE, UH, DETAILS ABOUT WHAT WE'RE DOING.

WE DO HAVE AN ELECTRONIC COPY OF WHAT YOU ALL HAVE A PRINTED OUT COPY.

UH, WE HAVE A PRINTED OUT COPY AS WELL AT THE LIBRARY OF THE NEW CHANGE.

IT'S ABOUT, LET ME GET THE PAGES 147 PAGES WHERE WE ARE REWRITING OUR CURRENT ZONING ORDINANCE.

UM, SO WHAT WAS KIND OF LIKE, UM, WE'RE GOING TO DELETE THE ONE WE HAVE AND PUT IN NEW PROVISIONS.

UM, THE NOTICE THAT YOU STATED JUST NOW EXPLAINED ALL THE THINGS WERE CHANGING.

WE ALSO HAVE ON THE WEBSITE, THE NEW ZONING MAP, UM, BECAUSE THE ZONING MAP ITSELF WILL ALSO CHANGE, UH, EXPLAINING WHERE, UM, YOU KNOW, WHERE CITIZENS CAN GO AND LOOK TO SEE HOW THEIR PROPERTY IS ZONED TO KNOW HOW THEY CAN MOVE FORWARD.

UM, AND AGAIN, THAT IS ON OUR PORT ARTHUR, TX.GOV, AND WE DO HAVE A HARD COPIES AVAILABLE.

UM, AGAIN, IT WAS RAN IN THE PORT ARTHUR NEWS, BEAUMONT ENTERPRISE.

SO JUST THE BOTTOM LINE IS THAT WE HAVE MET ALL OF THE LOCAL GOVERNMENT REQUIREMENTS AS FAR AS NOTICE.

AND, UH, WE'RE HERE TODAY TO JUST GET ANY PUBLIC COMMENTS AFTER THE PUBLIC COMMENT, PERIOD IS OVER AND WE ADJOURNED THE MEETING.

WE'LL GIVE YOU SOME OTHER DIRECTION.

WE JUST HAVE, UM, ONE RESOLUTION THAT'S GERMANE TO THIS, AND THEN WE HAVE ANOTHER RESOLUTION FOR CITY BUSINESS.

AND WE DID PRESENT THEM AT THE LAST PUBLIC WORKSHOP WE HAD AND WE ARE REVIEWING, UH, TO ENSURE THE MAP TO ENSURE THAT, UH, EVERYTHING IS IN ORDER AND THAT, UH, UH, WE HAVE, UH, IT COULD, WE WERE KIND OF WAITING ON THAT, SO IT COULD BE APPROVED BY THE CITY COUNCIL AND WE STILL HAVE A FEW MORE, UH, LITTLE THINGS TO TWEAK ON THAT MAP, BUT, UH, IT SHOULD BE READY BY THE TIME THE CITY COUNCIL APPROVES THE ZONING ORDINANCE AND PAY HIM.

IS THERE ANYTHING ELSE THAT I MISSED? NO.

WE MET WITH THE DIRECTOR OF PLEASURE ALLEY, MR. GEORGIA DAVIS, UM, IN REGARDS TO IDENTIFYING THE ZONING DESIGNATIONS THAT WOULD BE APPROPRIATE, UH, FOR THE ISLAND, UM, AS IT CURRENTLY IS.

AND ALSO FOR FUTURE USES, UM, THE 36 ACRE TRACK.

UM, WE HAVE, UH, PROPOSED, UH, ZONING FOR MIXED USE.

UM, BASED ON AGAIN, WHAT'S CURRENTLY THERE AND THE FUTURE USE OF THE LAND.

UM, FOR THAT 36 ACRES, WE ALSO, UH, TOOK INTO CONSIDERATION PROPERTIES LOCATED, UM, NEAR THE, UH, IS IT THE CAUSEWAY BRIDGE, UM, THAT LEADS TO CAMERON LOUISIANA.

UM, THERE IS A LOT OF RESIDENTIAL STRUCTURES ALONG THAT THOROUGHFARE.

UM, SO WE LOOKED AT ITS CURRENT ZONING, WHICH WAS HEAVY COMMERCIAL, AND WE'RE PROPOSING THAT, THAT BE LOW DENSITY RESIDENTIAL, UM, TO PROTECT THOSE HOMEOWNERS IN THAT AREA.

UM, OUTSIDE OF THAT, AS MR. BATON STATED, WE ARE AGAIN REVIEWING THE MAP TO MAKE SURE EVEN THE MOST RECENT ZONING CHANGES THAT WERE APPROVED BY COUNCIL, UM, HAVE BEEN AMENDED UPON THE PROPOSED MAP.

SO WHEN IT COMES BACK TO COUNCIL FOR ADOPTION, WE WOULD HAVE COVERED OUR OP ALL OF OUR BASES.

UM, IS IT POSSIBLE, OR DOES OUR ZONING ORDINANCE, UH, DICTATE OR MANDATE WHERE, OR WHAT TYPE OF FENCES CAN BE UTILIZED IN PARTICULAR COMMUNITIES WITHOUT AN HOA? I MEAN, WE DON'T HAVE HOS, BUT IN HOS IT TELLS YOU THAT YOU CAN'T PUT A, YOU KNOW, A CHAIN LINK FENCE AROUND THE HOUSE OR WHATEVER.

AND WE HAVE SEEN IN OUR, IN OUR COMMUNITIES WHERE INDIVIDUALS HAVE PUT CHAIN LINK FENCES IN PLACES WHERE THAT IS NOT THE NORM FOR THAT, YOU KNOW, FOR THAT PARTICULAR NEIGHBORHOOD, DOES THIS ORDINANCE DO THAT FOR US OR, OR DO WE HAVE THE ABILITY TO DO THAT? CAN ANYONE PUT ANY TYPE OF FENCE THEY WANT AROUND THEIR HOUSE IN OUR COMMUNITIES WITHOUT AN HOA? I DON'T THINK WE DICTATE EXACTLY WHAT KIND OF FENCE THAT THEY COULD HAVE, BUT I THINK THAT IN THE SUBDIVISION REGULATIONS THAT WE PUT OUT IN THE FUTURE, THAT'S COMING UP, THERE MAY BE AN OPPORTUNITY TO DO SOMETHING LIKE THAT.

BUT PAM, I DON'T KNOW THAT WE CAN'T CAN.

AND THE CURRENT ORDINANCE, WE DO TALK ABOUT, UM, THE TYPES OF MATERIALS THAT AREN'T TO BE USED.

UM, IF YOU LOOK AT, UH, FOR SECTION 4.03, B NUMBER THREE, FENCES SHALL NOT BE CONSTRUCTED OF SHEET METAL, METAL ROOFING, OR SIMILAR MATERIALS.

AND THE REASON WHY I ASKED THAT QUESTION, UM, UH, THERE WAS AN INDIVIDUAL IN OUR, IN THE NEIGHBORHOOD AND THEY PUT A CHAIN LINK FENCE AROUND THE HOUSE AND EVERYBODY WENT TO EPILEPTIC, LOST IT BECAUSE ALL OF THE FENCING WAS PRIVACY FENCING AND THOSE KINDS OF KINDS OF THINGS, YOU KNOW? UH, AND SO, AND IT, AND IT WAS A DETERRENT TO THE, TO THE FACE OF THE NEIGHBORHOOD AND TO, YOU KNOW, TO WHAT WAS HAPPENING.
