AND IT'S ALSO BEFORE YOU THAT THIS IS 35.2, FOUR ACRES OF LAND IN PLEASURE ISLAND THAT, UH, THE COUNCIL HAS DECIDED THAT, UH, WE WOULD LIKE TO PLACE UP FOR SALE. ACCORDING TO STATE LAW AND ELECTION IS REQUIRED. ANOTHER CRITICAL REQUIREMENT IS THAT THE TEXAS PARKS AND WILDLIFE CODE STATES AND SECTION 26.018, THAT A MUNICIPALITY OF THE STATE OF TEXAS MAY NOT APPROVE ANY PROGRAM OR PROJECT THAT REQUIRES THE USE OF ANY PUBLIC LAND DESIGNATED OR USE UNDER A PRIOR ARRANGEMENT, UH, AS A PARK RECREATION AREA, SCIENTIFIC AREA, WILDLIFE RESTAURANT REFUGE, HISTORIC SITE, UNLESS THE MUNICIPALITY THROUGH ACTING THROUGH ITS DULY AUTHORIZED GOVERNING BODY DETERMINES THERE'S NO OTHER USE FOR THE LAND OR THAT A PROGRAM OR PROJECT, UH, WILL MINIMIZE HARM TO THE LAND. UM, SO BASICALLY, UH, IT HAS TO BE SUBMITTED TO THE VOTERS AND A PUBLIC HEARING IS REQUIRED UNDER SECTION 26.02. SO WHERE DID WE, WHAT DID WE DO? SO WHEN LOGAN PARK WAS GIFTED TO THE CITY, THEY PUT THE WHOLE, UM, LEGAL DESCRIPTION THAT WAS THERE FOR PLEASURE ISLAND. THE AREA IN WHICH WE ARE TALKING ABOUT IS NOT WHAT WE USE FOR LOGAN PARK. SO IN THE NEXT SLIDE, WE'RE GOING TO START, I'M GOING TO GIVE AN OVERVIEW OF THE GENERAL CHANGES. SO THE ORIGINAL DOCUMENT HAD A NUMBER OF THINGS THAT WE JUST WANTED TO REORGANIZED. SOME OF THE BIGGEST CHANGES THAT YOU'RE GOING TO NOTICE ARE A REORGANIZATION OF THE DOCUMENT AND THE CHAPTER STRUCTURE, UH, PREVIOUSLY THINGS WERE SEPARATED OR REPETITIVE, REPETITIVE. AND SO WE WANTED TO REORGANIZE THAT STRUCTURE TO BETTER ALIGN WITH USABILITY. WE WANTED TO IMPROVE THE READABILITY OF THE DOCUMENT, PROVIDE MORE ILLUSTRATIONS, IMPROVING THE FORMAT, INCORPORATING CHARTS OR TABLES WHERE NECESSARY. SO INSTEAD OF HAVING A LOT OF WORDS TO READ, BEING ABLE TO JUST VIEW A CHART AND EASILY IDENTIFY THE INFORMATION THAT YOU'RE LOOKING FOR, AND THEN REMOVING CONFLICTS IN THE TEXT, UH, MORE CONSISTENT TERMINOLOGY AND REPETITIVE TEXT, THAT'S BEEN IN MULTIPLE SECTIONS REPEATED OVER AND OVER WHERE IT COULD HAVE BEEN MORE STREAMLINED ON THE NEXT SLIDE, UPDATED THE DEFINITIONS IN ONE SINGLE DEDICATED SECTION OF THE D THE DEFINITIONS WERE LOCATED IN MULTIPLE PLACES THROUGHOUT THE ORDINANCE. SO WE WANTED TO CONSOLIDATE ALL OF THEM INTO ONE PLACE IN THE ORDINANCE. UH, SOME OF SOME OTHER ORDINANCES THAT WERE SEPARATE WERE NOW INCORPORATED INTO THE DOCUMENT, INCLUDING THE LANDSCAPE ORDINANCE AND HISTORICAL PRESERVATION COMMISSION. AND THEN WE ALSO WANTED TO REMOVE THE FEES FROM THE ZONING ORDINANCE AND PUT THOSE INTO A SEPARATE DOCUMENT AND JUST REFERENCE THAT FEES WILL BE ASSOCIATED WITH CERTAIN APPLICATIONS. SO THESE ARE SOME OF THE BIG PICTURE CHANGES THAT YOU'LL NOTICE IF YOU WERE TO LOOK AT THE CURRENT ZONING ORDINANCE TO WHAT IS PRESENTED IN FRONT OF YOU TODAY. SO NOW I WANT TO GO OVER THE, UH, THE ORGANIZATION OF THE ZONING ORDINANCE. I'M GOING TO GO THROUGH EACH OF THE DIFFERENT SECTIONS TO JUST GIVE AN OVERVIEW OF WHAT'S IN THAT SECTION. AND THE MAJOR CHANGES THAT YOU'LL NOTICE FOR THE DIFF THE TEXTS IN EACH SECTION, UM, IN THE FIRST SECTION, THIS IS WHERE WE'RE HIGHLIGHTING THE AUTHORITY OF THE ZONING ORDINANCE. UM, THOSE ADMINISTRATIVE DETAILS, HOW TO INTERPRET THE ZONING ORDINANCE AND AN OUTLINE OF DIFFERENT PROCEDURES AND VIOLATIONS ON THE RIGHT SIDE OF THIS SCREEN. OH, CAN YOU GO TO THE NEXT SLIDE PLEASE? ON THE RIGHT SIDE OF THE SCREEN, YOU'LL SEE EACH OF THE SECTIONS INCORPORATED THERE WITH THE DIFFERENT TITLES. UM, THIS IS REALLY AN ADMINISTRATIVE SECTION THAT JUST GIVES THE AUTHORITY TO THE ORDINANCE ON THE NEXT SLIDE AND SECTION TWO, THIS IS WHERE WE DIG INTO THE ZONING DISTRICTS. UM, THIS ESTABLISHES THE ZONING DISTRICTS AND ALSO PROVIDES AN OUTLINE OF THE DIMENSIONAL STANDARDS FOR EACH DISTRICT. THAT MEANS THE HEIGHT, THE WIDTH OF THE LOT, THE LENGTH OF THE LOT AND THOSE DIFFERENT THINGS THAT ARE REQUIRED FOR THE DEVELOPER TO KNOW IN ORDER TO DEVELOP ON THE PROPERTY. SOME OF THE NEW DIFFERENCES ARE GOING TO BE A NEW OVERLAY DISTRICT FOR THE OPEN SPACE AND PRESERVATION DISTRICT, A NEW MIXED USE DISTRICTS SOLELY FOR THE PURPOSE OF BEING ABLE TO INCORPORATE A MIX OF USES, PERHAPS RESIDENTIAL AND OFFICE COMMERCIAL USES RESIDENTIAL IN ONE AREA, A NEW DOWNTOWN DISTRICT, AND THEN SPLITTING THE ONE INDUSTRIAL DISTRICT INTO A LIGHT AND A HEAVY INDUSTRIAL. AND WE WANTED TO DO THAT TO REALLY SEPARATE WHERE THOSE LIGHTER MANUFACTURING, INDOOR USES OF THOSE FLEX SPACES, TECHNOLOGY TYPE USES WOULD BE DIFFERENT FROM HEAVIER INDUSTRIAL AREAS, WHERE THERE MAY BE SIGNIFICANT OUTDOOR USE, UH, NOISE, UH, IN OTHER NUISANCES OF THAT KIND OF NATURE. AND ON THE RIGHT SIDE, ONCE AGAIN, YOU CAN SEE THE DIFFERENT SECTIONS THAT ARE INCLUDED IN THERE. SO THEN ON THE NEXT SCREEN, YOU CAN SEE, UM, AN EQUIVALENCY TABLE HERE. AND THEN YOU'LL ALSO SEE HOW WE ADDED THE MIXED USE DISTRICT DOWNTOWN IN OPEN SPACE AND PRESERVATION DISTRICTS. SO THIS TABLE HELPS TO IDENTIFY THE OLD, TO THE NEW ON THE NEXT SLIDE. YOU CAN SEE AN EXAMPLE OF THE DIMENSIONAL STANDARDS ON THE LEFT SIDE OF THIS SCREEN IS A, A DIMENSIONAL STANDARDS TABLE. THIS IS ALL OF THE STANDARDS REQUIRED FOR EACH OF THE DISTRICTS. THE PURPOSE OF THIS IS TO WIN IN A LOT OF THE OLDER NEIGHBORHOODS. WHEN NEW DEVELOPMENT COMES IN, THE UPDATED REGULATIONS MAY NOT FIT THE CHARACTER OF THE EXISTING NEIGHBORHOOD. SO WE WANT TO HAVE THAT ACCOMMODATION SO THAT NEW DEVELOPMENT CAN MATCH THAT CHARACTER, WHETHER THAT BE WITH, FOR HEIGHT, SETBACK SIZE, SO THAT YOU'RE NOT REQUIRED TO MEET ALL OF THE UPDATED ONES. AND THEN YOU WOULD STICK OUT IN THAT NEIGHBORHOOD AND THEN A COUPLE OF MODIFIED DIMENSIONAL STANDARDS FOR SPECIFIC USES. AND THE NEW DOWNTOWN DISTRICT IS ALSO LOCATED WITHIN THIS SECTION. AND YOU CAN SEE ALL OF THE SUBSECTIONS ON THE RIGHT SIDE OF THE SCREEN IN SEC. AND SO ON THE NEXT SLIDE, I JUST WANT TO HIGHLIGHT THE DOWNTOWN DISTRICT. YOU CAN SEE THE MAP ON THE SCREEN AND WHAT IT DOES IS IDENTIFY THE DOWNTOWN CORE FROM THE DOWNTOWN EDGE. AND THEN A COUPLE OF BUILDING DESIGN CRITERIA INTENDED TO HELP ACTIVATE THE FIRST FLOOR THINGS LIKE HOW YOUR PEDESTRIAN ENTRANCES ARE ORIENTED TO THE STREET TO MAKE THEM MORE ACCESSIBLE TO THE PEDESTRIAN. UM, ONE OF THE OTHER THINGS I WANTED TO HIGHLIGHT HERE WAS THE ADDITION YOU CAN SEE IN SECTION SUBSECTION 6.01, APPLICABILITY, COMPLETENESS, AND EXPIRATION. THIS IS A STREAMLINED APPLICATION REVIEW ITEM WHERE ALL APPLICATIONS WILL GO THROUGH THE SAME PROCESS AND IT IDENTIFIES WHAT MAKES AN APPLICATE APPLICATION COMPLETE AND WHEN IT'S ACTUALLY SUBMITTED. AND THEN ON THE NEXT SLIDE FOR SECTION SEVEN DEFINITIONS, WHAT WE DID WAS CONSOLIDATED ALL DEFINITIONS INTO ONE LOCATION. IT WAS NOT CONTINGENT AT THAT TIME UPON MOTIVA WAS PLANS TO COME INTO DOWNTOWN. THAT WAS NOT A DISCUSSION THAT THE CITY HAD WITH MOTIVA AT THAT TIME, BECAUSE WE HAD A PLAN MOTIVA ADOPTED THAT PLAN AND MADE A DECISION TO COME INTO DIAL POP TIME, PORT AUTHOR. SO THAT PLAN WAS ACTUALLY USED AS A TOOL AND AS A CATALYST TO ACTUALLY PROMOTE DEVELOPMENT WITHIN DOWNTOWN. BUT THE PLAN WAS NOT CREATED BASED UPON THEIR DECISION. SO IT MOVING FORWARD, THE ZONING ORDINANCE IS JUST THE REGULATORY STANDARD ON HOW DEVELOPMENT WOULD TAKE PLACE IN TERMS OF WHAT ALLOWANCES WE WOULD HAVE. UM, AS ALWAYS AS THE CITY MANAGER STATED IN ALEXIS STATED, UM, IT IS A FLUID DOCUMENT. AND SO WE WOULD MAKE ANY AMENDMENTS OR ADJUSTMENTS THAT ARE NEEDED AS WE MOVE FORWARD. UM, BUT WE DEFINITELY WOULD HAVE THE FLEXIBILITY FOR ANY TYPES OF CHANGES THAT WOULD BE NEEDED TO, UM, HELP AND CONTINUE TO ENCOURAGE DEVELOPMENT WITHIN OUR DOWNTOWN AREA. OKAY. AND, AND I UNDERSTAND THAT MR MANAGER, BUT, UH, MY CONCERN IS, IS THAT AT ONE POINT WE WERE TALKING ABOUT 500 OFFICE WORKERS BEING DOWNTOWN AND, AND WE'RE AT THE SAME TIME, WE'RE MOVING A HUNDRED PLUS PEOPLE FROM OUR HEALTH DEPARTMENT FROM DOWNTOWN NOW. SO NOW THAT THOSE 500 PEOPLE ARE NOT COMING AND, AND, AND WE'RE IN THE MIDST OF MOVING OUR HEALTH DEPARTMENT AND THOSE EMPLOYEES THAT ARE FROM HERE FROM DOWNTOWN, IT, IT SEEMS LIKE THAT WOULD BE A HINDRANCE TO FURTHER DEVELOPMENT FOR RESTAURANTS OR ANY OF THE OLD TYPE SERVICES.
