UH, MANY OF YOU KNOW, THE CITY IS ALSO A MEMBER OF THE TEXAS MUNICIPAL LEAGUE.
SO YOU ALSO RECEIVE A LEGISLATIVE SERVICES THERE.
UH, HOWEVER, UH, BACK IN, I BELIEVE IT WAS 2017.
UH, UNFORTUNATELY THERE WAS AN EFFORT AT THE LEGISLATURE TO OVERTURN THE CITY'S INDUSTRIAL DEVELOPMENT AGREEMENTS.
AND THAT EFFORT GOT PRETTY FAR IN THE LEGISLATIVE SESSION.
UH, WE WERE NOT REPRESENTING YOU AT THE TIME.
AND SO THE CITY MADE THE DECISION THAT THEY NEEDED SOMEONE ELSE TO PAY REALLY CLOSE ATTENTION, NOT ONLY TO THOSE ISSUES, BUT TO OTHER ISSUES.
UH, I THINK, YOU KNOW, HOW IMPORTANT THOSE AGREEMENTS ARE TO THE CITY'S FINANCES.
AND SO THE CITY, UH, LOOKED AT SEVERAL FIRMS AND DECIDED TO HIRE US IN 2018.
UH, IT IS NOT UNUSUAL FOR CITIES TO HIRE, UH, LAW FIRMS TO, UH, TO REPRESENT THEM INDIVIDUALLY AT THE LEGISLATURE.
SO WE HAVE BEEN YOUR REPRESENTATIVES, UH, KINDA AS A SECOND EYES, UH, TO MAKE SURE THAT WE SPECIFICALLY, UH, LOOK OUT FOR THOSE VERY IMPORTANT ISSUES RELATED TO YOUR INDUSTRIAL DEVELOPMENT AGREEMENTS AND ALL OF THOSE ISSUES THAT, UH, RELATE TO THOSE AND THEN OTHER ISSUES.
SO I'M HERE TONIGHT TO KIND OF GIVE YOU A, JUST A VERY BRIEF OVERVIEW OF SOME OF THE ISSUES THAT, UH, OCCURRED DURING THE LEGISLATIVE SESSION.
I WANT TO FIRST BY THANKING YOUR STAFF, SPECIFICALLY, THE CITY MANAGER BURTON AND YOUR CITY ATTORNEY, MR. XENO FOR THEIR ASSISTANCE DURING THAT SESSION, UH, AS, UH, SOME OF, YOU KNOW, YOU'VE PROBABLY HAD A, UH, AN EXTENSIVE, UH, LEGISLATIVE, UH, UPDATE.
I KNOW TML HAS DONE ONE AND SOME OTHER ORGANIZATIONS HAVE, UH, IT WAS ANOTHER ONE OF THOSE SESSIONS WHEREBY UM, CITIES WERE VERY MUCH UNDER THE GUN.
UH, YOUR AUTHORITY CONTINUES TO BE CHALLENGED IN AUSTIN.
AND SO, UH, I THANK YOUR STAFF BECAUSE IT IS THROUGH YOU AND YOUR STAFF, THAT WE ARE ABLE TO TELL

THE MAYOR WAS VERY, VERY WILLING TO DO THAT.

SO BEFORE I START GOING OVER SOME OF JUST A FEW OF THE BILLS THAT I THINK I JUST WANT TO TALK TO YOU ABOUT, I WOULD JUST CONTINUE TO ENCOURAGE YOU TO REACH OUT TO MEMBERS OF YOUR DELEGATION, UH, YOU KNOW, INVITE HIM TO THINGS IN THE CITY, WHETHER IT BE GOOD OR BAD, JUST, YOU KNOW, WHATEVER YOU'RE DOING HERE, MAKE SURE THAT THEY KNOW ABOUT WHAT'S GOING ON IN HERE.
UH, THAT THEY'RE JUST NOT COMING HERE.

SO I'M GOING TO GO THROUGH JUST, JUST A FEW THINGS, UH, THAT I THINK THAT MAY BE IMPORTANT FOR YOU GUYS TO KNOW A FEW GOOD THINGS AND A FEW, MAYBE NOT SO GOOD THINGS, BUT JUST SOME THINGS I THINK I WANT TO PUT ON YOUR RADAR THAT I THINK MAY BE IMPORTANT TO THE CITY THAT HAPPENED IN AUSTIN.
AND THEN I'LL TALK A LITTLE BIT ABOUT WHAT'S GOING ON IN THE CURRENT SPECIAL SESSION THAT JUST TOUCH BRIEFLY ON YOU GUYS.
A LOT OF WHAT'S GONE ON IN SPECIAL SESSION IS MAYBE NOT SO MUCH GOING TO TOUCH ON YOU GUYS.
AND THEN I'LL TALK A LITTLE BIT ABOUT THIS INTERIM IN THE INTERIM WILL LAST UNTIL THE NEXT SESSION IN 2023.
SO FROM A PERSPECTIVE OF KIND OF POSITIVE THINGS, UH, HOUSE BILL FIVE WAS ADOPTED DURING THE REGULAR SESSION, AND THAT'S A BILL THAT'S GOING TO CREATE AN OFFICE OF BROADBAND SERVICES AND THE STATE COMPTROLLER'S OFFICE.
I THINK DURING THE PANDEMIC, MANY OF US LEARNED ABOUT THE FACT THAT BROADBAND SERVICES ARE NOT AS WIDELY AVAILABLE IN MANY PARTS OF THE STATE AS THEY SHOULD BE THOSE HIGH SPEED INTERNET SERVICES THAT ARE NECESSARY FOR NOT ONLY THE STATE TO GROW ECONOMICALLY, BUT FOR CITIZENS AND STUDENTS AND EVERYBODY TO HAVE HIGH SPEED INTERNET AND ALL THOSE OTHER SERVICES.
AND SO THIS NEW BROADBAND SERVICES OFFICE IS GOING TO HAVE ACCESS TO FUNDING.
A NEW, A NEW A FUND IS BEING CREATED IN THE STATE, UH, GENERAL FUND.
UH, THIS PARTICULAR OFFICE IS GOING TO DO A MAP OF THE ENTIRE STATE.
AND IT'S GOING TO LOOK AT AREAS OF THE STATE AND DESIGNATE THOSE AREAS THAT DON'T NECESSARILY HAVE ACCESS TO BROADBAND.
AND IN THAT IT'S GOING TO ALSO BE ABLE TO PROVIDE GRANTS TO THOSE AREAS THAT ARE LACKING IN THAT HIGH SPEED INTERNET ACCESS.
AND SO THOSE AREAS ARE GOING TO BE ABLE TO APPLY FOR THOSE GRANTS AND GOING TO BE ABLE TO WORK WITH THAT OFFICE TO HELP IMPLEMENT A MORE ROBUST BROADBAND SERVICES IN THOSE AREAS OF THE STATE.
SO I THINK, UH, AS THAT, UH, OFFICE GETS UP AND RUNNING, UH, THEY'RE PROBABLY GOING TO BE WORKING WITH LOCAL GOVERNMENTS AND PROBABLY NONPROFITS AND THOSE AREAS OF THE STATE.
AND SO THAT MAP WILL LOOK DIFFERENT DEPENDING ON WHAT AREA OF THE STATE YOU ARE, BUT IT'S GOING TO ASSIGN DIFFERENT REGIONS OF THE STATE AS TO WHERE THE GRANTS ARE GOING TO BE MOST NEEDED TO PROVIDE THOSE, UH, THOSE SERVICES AND THOSE GRANT FUNDS.
SO I DO THINK THAT THAT'S A POSITIVE, UH, THAT CITIES SHOULD BE LOOKING OUT FOR I'M NEXT, GOING TO TURN TO SOME OF, SOME OF THE, UH, WHAT I THINK ARE KIND OF POSITIVE PUBLIC SAFETY,

UH, LEGISLATION THAT WAS PASSED DURING THIS LAST SESSION.UH, AND, AND THERE THERE'S ONE AREA.
I THINK THAT WAS VERY POSITIVE AND IT RELATES TO, I THINK MOST OF YOU KNOW, HOW HUMAN TRAFFICKING IS A REALLY BIG PROBLEM IN THE STATE RIGHT NOW.
AND THERE WERE TWO PIECES OF LEGISLATION.
UH, THE FIRST ONE IS HOSPITAL THREE 90 AND IT CREATES THIS NEW HUMAN TRAFFICKING AWARENESS AND PREVENTION PROGRAM.
AND ONE OF THE KEY PROVISIONS OF THAT PROGRAM IS THAT IT ALLOWS POLICE OFFICERS TO ACTUALLY ENTER, UH, HOTELS AND MOTELS AND OTHER LODGING ESTABLISHMENTS DURING THE HOURS OF NINE, 9:00 AM AND 5:00 PM TO DETERMINE WHETHER OR NOT THOSE ESTABLISHMENTS ARE COMPLYING WITH THESE, UH, HUMAN TRAFFICKING AWARENESS AND PREVENTION PROGRAMS. SO, UM, IT ALSO SAYS THAT CITIES CAN'T CREATE HUMAN TRAFFICKING AWARENESS AND PREVENTION PROGRAMS, AND THAT'S YOUR CITY PROGRAMS CAN PROVIDE FOR TRAINING.
AND THAT CITY PROGRAMS CAN BE MORE STRINGENT THAN THE STATE PROGRAMS. SO THE STATE PROGRAMS WON'T PREVENT WON'T PREEMPT LOCAL PROGRAMS. SO, UH, YOU KNOW, THAT'S ONE AREA WHERE THE STATE'S NOT GOING TO PREEMPT CITIES AUTHORITY IN THAT AREA.
THE SECOND BILL THAT DEALS WITH HUMAN TRAFFICKING IS HOUSE BILL 4 0 2.
AND THAT PARTICULAR PIECE OF LEGISLATION BASICALLY SAYS THAT IF YOUR LAW ENFORCEMENT OFFICERS HAVE, UH, CONFISCATED, UH, SOME, UH, SOME ASSETS RELATED TO HUMAN TRAFFICKING, THEY CAN USE THOSE ASSET FORFEITURE FUNDS TO FUND, UH, CERTAIN, UH, PROGRAMS THAT CAN HELP THE VICTIMS OF HUMAN TRAFFICKING.
SO THOSE ASSET FORFEITURE FUNDS THAT HAVE BEEN FORFEITED FROM HUMAN TRAFFICKING CAN BE USED TO HELP FUND PROGRAMS TO ASSIST THOSE VICTIMS OF HUMAN TRAFFICKING.
SO THAT'S A REAL POSITIVE IN THAT PARTICULAR ARENA.
UH, ONE OF THE, UH, THERE, THERE ARE TWO OTHER, I THINK, UH, MAYBE, OR MAYBE THREE OTHER, UH, I WANT TO REALLY TOUCH ON IN THE, IN THE PUBLIC SAFETY ARENA.
I THINK ONE OF THE ONES THAT I THINK PROBABLY MOST PEOPLE HAVE HEARD ABOUT IS, UH, THE PERMIT LIST, CARRY BILL HOUSE BILL A 1927, BASICALLY THAT BILL ALLOWS, UH, CITIZENS OVER THE AGE OF 18, UH, TO CARRY, UH, WEAPONS WITHOUT A PERMIT OR WITHOUT LICENSE, WITHOUT TAKING ANY TRAINING LICENSING, SENIOR TRAINING.
HOWEVER, IT PROHIBITS THE CARRYING OF A WEAPON IN A MEETING LIKE THIS, OR, UH, IN, UM, IN A POLLING PLACE.
AND THEN SOME OTHER PLACES, YOU KNOW, PLACES WHERE, UH, IF THEY'RE SERVING ALCOHOL, IF THOSE ESTABLISHMENTS HAVE POSTED A SIGN AND IN A CHURCH, IF THEY'VE POSTED, ASSIGN, BUT BASICALLY, UH, THERE IS GOING TO BE, PERMITLESS CARRY IN THE STATE OF TEXAS NOW, UH, UH, ALSO WANT TO CALL YOUR ATTENTION TO HOUSE BILL 9 27, UH, RELATES TO, UH, BODY-WORN CAMERAS FOR POLICE OFFICERS.
UH, IT REQUIRES THAT YOU HAVE TO HAVE POLICIES FOR THAT, THAT BILL IS REFERRED TO AS THE BOTHAM JOHN ACT.
AND I THINK MOST OF YOU REMEMBER MS. THIRD, JOHN, HE WAS A YOUNG MAN IN DALLAS WHO UNFORTUNATELY WAS KILLED WHILE HE WAS IN HIS APARTMENT.
UH, UH, AND, UH, I GUESS DURING THAT PARTICULAR INCIDENT, UH, THE POLICE OFFICERS WHO WERE INVESTIGATING THEY AT ONE POINT DURING THE INVESTIGATION OF THAT SHOOTING, THEY TURNED OFF THEIR CAMERAS.
AND SO THIS PARTICULAR BILL HOUSE BILL 9 27 SAYS THAT, UH, POLICE DEPARTMENTS, UH, POLICY ON BODY-WORN CAMERAS HAS TO PROVIDE THAT BOTH THE AUDIO AND VIDEO RECORDING MUST CONTINUE TO RECORD BOTH THE AUDIO AND VIDEO DURING THE ENTIRE TIME OF THAT INVESTIGATION.
SO, UH, AND IT WAS NAMED AFTER BOTHAM JOHN.
SO, UH, I'M SURE YOUR POLICE CHIEF IS AWARE OF THAT AND, AND YOUR POLICIES, IF YOU HAVE BODY-WORN CAMERAS WILL HAVE TO PROVIDE FOR THAT, THE FINAL, UH, PUBLIC SAFETY BILL I'D LIKE TO TALK TO YOU GUYS A LITTLE BIT ABOUT IS, IS, IS, UH, IS A, IS A NEW REQUIREMENT FOR YOUR PUBLIC SAFETY DEPART, UH, OFFICERS, BOTH POLICE FIRE.

BILL 2073, AND IT'S GOING TO REQUIRE THAT A CITY MUST PROVIDE THEIR PUBLIC SAFETY EMPLOYEES WITH QUARANTINE LEAVE, AND THIS IS GOING TO BE A SEPARATE TYPE OF LEAVE.AND IT'S BASICALLY GOING TO SAY THAT YOU'RE GOING TO HAVE TO PROVIDE PAID TIME OFF AND PAID ACCOMMODATIONS FOR YOUR PUBLIC SAFETY EMPLOYEES WHO ARE EXPOSED TO SOME TYPE OF COMMUNICABLE DISEASE WHILE THEY ARE ON DUTY, AND YOU CANNOT REQUIRE THEM TO USE UP ANY OF THEIR OTHER TYPE OF ACCRUED LEAVE.
SO IT'S GOING TO HAVE TO BE A SEPARATE LEAVE BANK FROM ANY KIND OF VACATION, ANY OTHER TYPE OF SEEK LEAVE.
IT'S GOING TO HAVE TO BE A SEPARATE ACCRUE QUARANTINE LEAVE.
SO, UM, I'M SURE YOUR PUBLIC SAFETY, UH, LEADERS ARE LOOKING AT THAT, BUT IT'S GOING TO BE SEPARATE FROM ANY OTHER LEAVE.

AND THEN I'LL TALK ABOUT THE SPECIAL SESSION, UH, HOUSE BILL 80, UH, WILL PROHIBIT, UH, MUNICIPAL COURTS FROM IMPOSING FINES OR COURT COSTS AGAINST DEFENDANTS WHO ARE UNDER THE SUPERVISION OF THE TEXAS, UH, FAMILY AND PROTECTIVE SERVICES OR ANY ANYONE WHO'S IN FOSTER CARE.

IF THEY'RE ACCOMPANYING A DEFENDANT IN COURT, A HOUSE BILL 16, UH, 93 IS A BILL THAT SAYS THAT, UH, MUNICIPAL COURTS CAN NOW HAVE ACCESS TO THE STATE'S, UH, FINANCIAL RESPONSIBILITY VERIFICATION PROGRAM.
AND THAT'S THE ONLINE DATABASE TO DETERMINE WHETHER OR NOT SOMEBODY HAS INSURANCE WHEN THEY GET A TICKET FOR NO INSURANCE, BUT THERE'S A COST TO ACCESS THAT DATABASE.
AND THE BILL SAYS THAT YOU CANNOT PASS THAT COST ONTO THE DEFENDANT THAT THE CITY HAS TO BEAR THE COST OF THAT.
SO IT SAYS YOU CAN HAVE ACCESS TO THAT COST, BUT IT SAYS THE CITY MUST PAY THE COST OF THAT.
